5. Cookies and Tracking Technologies

Our website uses cookies and similar technologies to improve functionality, analyze traffic, and enhance your experience. This section explains what these technologies are, how we use them, and how you can control them.

5.1 What Are Cookies?

Cookies are small text files placed on your device by a website you visit. They allow the website to remember your actions and preferences over time so you do not have to re-enter them each visit. Cookies may be “session cookies” (deleted when you close your browser) or “persistent cookies” (stored until they expire or you delete them).

5.2 Types of Cookies We Use

Strictly Necessary Cookies

These cookies are essential for the website to function. They enable core features such as security, page navigation, and form submission. You cannot opt out of these cookies through our cookie settings because they are required for the site to work.

Functional / Preference Cookies

These cookies remember choices you make (such as language preferences) and provide enhanced, personalized features. They may be set by us or by third-party providers whose services we have integrated.

Analytics and Performance Cookies

These cookies help us understand how visitors interact with our website — which pages are most visited, where visitors arrive from, and how long they stay. This data is used in aggregate and does not identify individual users. We may use services such as Google Analytics for this purpose.

Marketing and Targeting Cookies

We may use third-party cookies to help measure the effectiveness of our fundraising or outreach campaigns. These cookies track website visits and interactions to help us understand the impact of our messaging. We do not use these cookies to sell your data or display advertisements for commercial products.

5.3 Third-Party Cookies

Some cookies on our website are set by third-party services we use, including:

  • Google Analytics — website traffic analysis (Google LLC)
  • Payment processors — secure donation processing
  • Social media platforms — if you interact with share or follow buttons

These third parties have their own privacy policies governing their use of cookies. We encourage you to review those policies independently.

5.4 Your Cookie Choices

You have several options for controlling cookies:

Browser Settings

Most web browsers allow you to control cookies through their settings. You can set your browser to refuse cookies or to alert you when cookies are being sent. Please note that disabling cookies may affect the functionality of some parts of our website.

Google Analytics Opt-Out

You can opt out of Google Analytics tracking by installing the Google Analytics Opt-Out Browser Add-On, available at tools.google.com/dlpage/gaoptout.

Do Not Track

Some browsers include a “Do Not Track” (DNT) setting. We currently do not alter our data collection practices in response to DNT signals, as no universal standard for interpreting DNT has been established. We will update this policy if that changes.

6. How We Share Your Information

We do not sell, rent, or trade your personal information. We treat all personal information — especially information shared by families in crisis — with strict confidentiality. We may share information only in the following limited circumstances:

6.1 Service Providers

We may share information with trusted vendors and service providers who assist us in operating our website, processing donations, or delivering communications. These providers are contractually obligated to keep your information confidential and use it only for the services they provide to us.

6.2 Legal Requirements

We may disclose information if required to do so by law or in response to a valid legal process, including a court order, subpoena, or governmental request.

6.3 Protection of Rights

We may disclose information when we believe disclosure is necessary to protect the rights, property, or safety of The EverHeld Foundation, our staff, or others.

6.4 Organizational Changes

If The EverHeld Foundation undergoes a significant organizational change — including merger, acquisition, or dissolution — personal information may be transferred as part of that change. We will notify you before your information is transferred or becomes subject to a different privacy policy.

6.5 With Your Consent

We may share your information in any other circumstance with your explicit consent.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • Donor records are retained as required by IRS regulations governing 501(c)(3) organizations
  • Family assistance records are retained to document our charitable activities and for compliance purposes
  • Email and SMS opt-in records are retained for the duration of the communication relationship and for a reasonable period after opt-out to demonstrate compliance
  • Website analytics data is subject to the retention policies of the analytics provider (e.g., Google Analytics)

When we no longer need your information, we will securely delete or anonymize it.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, disclosure, alteration, and destruction. These measures include:

  • Secure (SSL/TLS) encryption for data transmitted through our website
  • Access controls limiting who can access personal information internally
  • Secure, reputable third-party payment processors for donation transactions — we do not store full payment card numbers

No method of transmission over the internet or method of electronic storage is 100% secure. While we take the protection of your information seriously, we cannot guarantee absolute security. If you have reason to believe your interaction with us is no longer secure, please contact us immediately.

9. Children’s Privacy

Our website is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent. If we become aware that we have inadvertently collected information from a child under 13, we will delete it promptly.

If you believe we have inadvertently collected information from a child under 13, please contact us at [privacy@theeverheldfoundation.com].

10. California Privacy Rights

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:

  • The right to delete personal information we have collected from you (subject to certain exceptions)
  • The right to correct inaccurate personal information
  • The right to opt out of the sale or sharing of personal information (we do not sell personal information)
  • The right to non-discrimination — we will not discriminate against you for exercising your privacy rights

To exercise any of these rights, please contact us at [privacy@theeverheldfoundation.com] or call 1-844-EVERHLD. We will respond to verifiable requests within 45 days.

11. Links to Other Websites

Our website may contain links to external websites, including payment processors, social media platforms, and partner organizations. This Privacy Policy does not apply to those external websites. We encourage you to review the privacy policies of any website you visit through links on our site.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. We will post the updated policy on our website with a revised effective date. For significant changes, we will take reasonable steps to notify you — for example, by posting a prominent notice on our website or sending an email to subscribers.

Your continued use of our website or services after any changes to this Privacy Policy constitutes your acceptance of the revised policy.
